New Discovery Rules in Germany for Antitrust Damage Claims

The European Directive 2014/104/EU on antitrust damages actions (Antitrust Damages Directive) aims to make it easier to pursue damage claims in case of anti-trust infringements. For this purpose, the Antitrust Damages Directive provides that EU member states shall provide parties to an antitrust damages action with the right to request disclosure of documents that are necessary in connection with such a claim. With the adoption of the 9th Amendment Package to the German Act against Restraints of Competition, the German legislator transposed this requirement of European law into national law.
